Law regarding arbitrary building constructions

Published in the Government Gazette (GG 209/21-9-2011) the new law 4.014/2011 for arbitrary houses, which provides the guidelines in order to maintain the arbitrary constructions of buildings (residential, industrial, etc.) which were built not in a lawful way for 30 years. The beneficiaries will need to pay a very small amount compared with the profit gained, and especially in areas of high objective value (such as the Old Psychiko the Filothei, Vouliagmeni, Mykonos, etc.) the benefit is particularly important.

The process begins on October 1 and runs until November 30, 2011 and initially only requires:

1. A request and an application for the owner

2. A fee of 500 € to 6.000 €, depending on the surface of the property

3. A form with the exact calculation of the fine, stating the arbitrary constructions


These shall be submitted electronically and the system issues a "unique number" for reference. Then there should be a study and together with the respective drawings, should be submitted by March 31, 2012. Then the exact fine and the repeated doses will be calculated. When the submission of the documents is finished, an automated message is coming from the online system saying "NOTICE SETTING AFTHERETO", which will include all the elements integrated. The certificate is necessary to demise the house in to the next generations.

The single specific penalty to be paid by the owners is calculated based on the size, price band, a rate of 15%, whether or not a building has a permit, the location of the building(whether it is inside the rural area limits), the type of use (main single dwelling, other use, etc.), the type of planning breach (by expansion and / or height building exceeded, excess coverage, infringement of lateral distance and / or building line), change in use of planning permission and other violations.

Major points of interest are:

For arbitrary constructions that are up to 20 square meters and do not exceed the 10% of the maximum height and 20% of the maximum allowable construction, fixed lump sum of 1.500 € (off plan) and 2.000 € (in plan) is defined, for to a zone price band of 2.500 € and 3.000 € for a zone price band higher than 2500 €.

If the fine is paid in one installment, a discount of 20% is applied.

The fine is payable within thirty (30) months for homes and within thirty six (36) months for property other usage, partly in equal installments, the number of which is determined by the Minister of Environmental Protection. The first installment shall be paid within three (3) months from the commencement of this Act.

If the fine is less than 400 € (after deducting the amount of the fee), then it should be paid off until 31.12.2011
